Need some advice here!
I got my biz registered with FinCEN but no state license. Got a bunch of undocumented folks wanting to buy Bitcoin from me. Can I sell to them? Or do I need something like a no-action letter? They have US bank accounts.
Is it legal to sell Bitcoin to undocumented immigrants?

Do you even need ID from them? Seems like their bank should handle that stuff. If it’s a US bank account, it might not really be your issue...
Check the laws on selling small amounts. I heard anything under $5k doesn’t usually require ID. If it’s small sums like $20, unlikely anyone will notice.

I doubt you'll get any no-action letters for this situation.
From what I know, selling Bitcoin to undocumented folks isn’t illegal, but you should definitely follow FinCEN and state rules. Be sure about needing a state license; many states have that requirement.

If they can buy houses and cars, I don’t see why you can't sell them Bitcoin. Just because they’re undocumented doesn’t mean they can’t pay for stuff. Cash is king after all. Don't sweat it too much.

There’s no law stopping you from selling Bitcoin to undocumented immigrants. They can get ITIN numbers and buy property, so you should be fine. Just check if you need a state license before you start. Talk to a lawyer to be safe.

Shouldn’t you ask for an SSN or ITIN, since KYC is a thing? If they need an SSN, then it’s tricky because undocumented folks usually don’t have that. But they can get ITINs, so that's a workaround.
For small amounts, probably won’t matter much.
Honestly, selling Bitcoin to undocumented immigrants isn’t really a problem. It’s just an online transfer; not illegal in the US, right? Plus, Bitcoin is kinda anonymous anyway.

If you're selling guns, sure, check licenses. But with Bitcoin, there aren’t those rules. You can trade with anyone. And honestly, you can't even tell who's legal or illegal half the time.
From my view, no need to worry about action letters with small dollar deals. Undocumented folks buy from big companies without issues, so I don't see why you’d have a problem.

Absolutely, if they can shop at malls, selling Bitcoin should be fine. Just keep tabs in case they use it for something illegal. But otherwise, you’re good.

I totally agree, no issues with undocumented immigrants buying Bitcoin. Haven't seen rules against it. Maybe just ask for their ITIN for paperwork.
