Can a Divorce Court Access My Bitcoin?

A buddy of mine is going through a nasty divorce. He just found out his wife was cheating on him. In the process, he's transferred a lot of his assets into around 850 bitcoins. Now that he's filed for divorce, her lawyer believes he’s hiding more money than he claims. The judge wants him to hand over everything to split with her. Can they actually access his bitcoin wallet?

I mean, if he says he lost it all gambling on some site, he might be in the clear.

Honestly, no one can just take your bitcoins without proof! If she knows his wallet address, he could just move them to another wallet and claim they got stolen.

But if the judge finds out he has a wallet and he doesn't declare it, that could land him in some serious trouble. Contempt of court is no joke, and he might face jail time.

If he's in a community property state, the court could really drill down on him. They might even find where he bought his BTC. But if not, she might be stuck negotiating.

Yeah, but even in some states, just being suspected of hiding assets can get him in hot water. No proof needed.

They'll track the money trail. If he mixed it up at a dark pool, that could help him. But still, she gets to cheat and he gets the short end of the stick in court.

Married guys should be all over using bitcoin. It’s a smart way to protect assets. Plus, with DNA tests becoming more common, guys can defend themselves better against cheating wives.

I can relate. I’ve got a chunk of my assets in BTC too, and only a couple of close friends know. Most of my wealth is in real estate, which is safe from divorce claims.

Honestly, he should’ve held off on this divorce for a bit longer. If his BTC came from exchanges, they can trace where it came from.

Crazy that the court can force you to share your stuff. Heard some rich dudes are paying crazy alimony. What's the deal with that?

It’s wild! Courts can really go after people. Bitcoin is considered an asset now, so hiding it isn't a good excuse.

In the UK, prenups don’t mean much in court. It’s even worse than the US.
