Anyone can create a currency if they hire a dev or have the skills. But launching it and getting it on exchanges costs money. If the state doesn’t legalize bitcoin, how will they approve a new currency?

I think it’s mostly legal. Many have created their own currencies. But whether it’s accepted widely depends on state policies. Most places probably don’t want new currencies competing.
